Southwick Board of Health hears legal case for active BESS oversight role as solar project nears. The board met Tuesday and received an hour-long presentation from Mike Hugo, Director of Strategy and Government Relations for the Massachusetts Association of Health Boards, who argued that under Massachusetts General Laws Chapter 111 the board holds authority to impose enforceable conditions on — or, in an extreme case, shut down — any battery energy storage system facility after construction, regardless of state Energy Facility Siting Board approval. Hugo contrasted two recent EFSB proceedings: the Tewksbury board of health's active participation produced 108 conditions on a BESS project, the majority addressing public health, while a Wareham board that was not at the table saw only three or four conditions imposed.

"The CAO and the select board do not control the board's statutory powers," Hugo told the board, adding that EFSB general counsel called him the morning after he filed public health comments, saying, "we hadn't even thought about the Board of Health in this thing." In other business, the board voted 3-0 to authorize food safety consultant Danny Lee to conduct three unannounced inspections at New Main Moon restaurant over one month, with immediate notification required for critical violations, and voted 3-0 to establish a public-education Facebook page for the board.
